These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Cull, operated by Tomas Giannini, Ontario, Canada ("we," "us," or "our"), governing your access to and use of the Cull mobile application and related services (collectively, the "Services"). By creating an account, registering for a tournament, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
You must be at least 18 years of age to use the Services. By creating an account, you represent and warrant that you are 18 years of age or older. We reserve the right to request proof of age at any time and to suspend or terminate accounts that do not meet this requirement.

Cull is a sports event management and registration platform for physical fishing competitions. We provide tournament organization tools, catch verification technology, and scoring infrastructure for physical catch-and-release fishing competitions organized by tournament directors.
Cull provides an online platform for organizing, registering for, and competing in physical fishing tournament events. Tournament organizers may provide their own terms and conditions to tournament participants. Tournament organizers are solely responsible for the tournaments they organize, including rules, results, and prize distribution. Cull has no liability to tournament participants for prizes, awards, or results except as expressly provided in these Terms.
Key characteristics of Cull tournaments:
Catches must be submitted through the App during the tournament window using the Catch Locker, which requires a bump board photo, hero photo, and release video. Submissions are analyzed using AI (including Apple Vision for on-device OCR and the Anthropic API for species verification). We reserve the right to perform additional manual review on any submission.
GPS location data is collected at the time of submission to verify the catch was made within the tournament boundary using Ontario Hydro Network (OHN) geofencing. You represent and warrant that all catch submissions are genuine, unaltered, and accurately represent a fish you personally caught during the tournament window.
The following conduct is prohibited and may result in immediate disqualification, forfeiture of awards, and permanent account termination:
Some tournaments require a registration fee to participate. Registration fees are clearly displayed before you register for a tournament. By registering for a paid tournament, you authorize us to charge your payment method the specified registration fee through our payment processor, Stripe.
Cull reserves the right to retain a service fee from registration fees collected. The service fee percentage applicable to each tournament is disclosed on the tournament details page before registration. At the time of launch, the platform service fee is set to 0%. The service fee may be introduced or adjusted in the future with notice to users as described in Section 13.
Registration fees are non-refundable once a tournament has started. If you drop out of or fail to participate in a tournament after it has commenced, you will not receive a refund. Refunds may be issued at our sole discretion in the following limited circumstances:
Refunds for cancelled tournaments are processed to the original payment method via Stripe. Refund requests must be submitted within 7 days of the relevant tournament by contacting roseranger.contact@gmail.com.
Tournament awards and prizes are the sole responsibility of the tournament organizer/director. Cull collects registration fees on behalf of tournament organizers and remits collected fees to the tournament organizer less applicable service charges following the conclusion of the tournament. The tournament organizer is solely responsible for distributing awards to participants. Cull does not distribute prizes or awards to individual participants. All prize distribution occurs outside of the application.
Cull makes no representations or warranties regarding the awards, results, or other aspects of any tournament organized through the platform. You are solely responsible for any taxes payable on awards you receive from tournament organizers.
Cull features an angler ranking system that awards Experience Points (XP) based on tournament performance. The following rules apply:
All content, features, and functionality of the Services — including but not limited to the App design, text, graphics, logos, and software — are owned by Cull and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.
By submitting catch photographs and videos through the Services, you grant Cull a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce those photographs and videos for the purposes of operating the Services and promoting Cull, including leaderboard displays, tournament records, social media, and marketing materials. You retain ownership of your original content.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Disputes regarding tournament results, catch verification, or scoring must be submitted within 48 hours of the tournament's conclusion by contacting roseranger.contact@gmail.com. Cull will review all disputes and render a final decision within 14 business days. Cull's decision on tournament disputes is final and binding.
Tournament results are subject to a mandatory 48-hour review window. During the 48-hour review period, any participant may raise a dispute regarding the results before the tournament organizer distributes awards. Disputes raised after awards have been distributed by the tournament organizer will not result in clawback except in cases of confirmed fraud.
For disputes not related to tournament results, you agree to first attempt to resolve the matter informally by contacting us at roseranger.contact@gmail.com. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of the Province of Ontario, Canada, which shall have exclusive jurisdiction.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your right to use the Services ceases immediately. Any pending awards for verified, undisputed tournament results will be the responsibility of the tournament organizer to distribute. Registration fees for tournaments that have already started are non-refundable upon termination.
You agree to indemnify, defend, and hold harmless Cull and Tomas Giannini from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any applicable law or regulation.
We may modify these Terms at any time. Material changes — including any introduction or change to the platform service fee — will be communicated through the App or via email at least 14 days before they take effect. Your continued use of the Services after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Services and delete your account.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with the Privacy Policy and any tournament-specific rules, constitute the entire agreement between you and Cull regarding the Services and supersede all prior agreements, representations, and understandings.
